The Jurisprudential Distinction Between “Precario” and Commodatum: An Analysis of Judgment No. 256/2026 of 5 May, Delivered by the Provincial Court of Huesca

An insightful article by our colleagues Núria Brunet Balcells and Júlia Canals Feliu from our Litigation team has just been published in Legal Today. In it, they analyse Judgment No. 256/2026 of the Provincial Court of Huesca, a particularly significant ruling on eviction proceedings based on precario (occupation without legal title), which reinforces legal certainty in this area.

This judgment is also especially meaningful for our firm, as it was issued in proceedings that we successfully led and defended, obtaining favourable decisions both at first instance and on appeal. We are currently awaiting confirmation as to whether the opposing party will file an appeal before the Spanish Supreme Court.
